What to Expect: Timeline

Before You Submit

After You Submit

Week 1-2: Processing

The court receives your documents and processes your request. They'll verify your bail payment and log your Trial by Written Declaration request.

Week 2-4: Officer Notification

The court sends a copy of your statement to the citing officer, who has a set period to respond with their own written statement.

Week 4-8: Review Period

A judge reviews all submitted materials, including:

  • Your written statement (MC-031)
  • Any evidence you included
  • The officer's statement (if submitted)
  • The original citation

Week 6-12: Decision

You'll receive the judge's decision by mail. The actual timeline varies by court workload - some courts are faster than others.

Possible Outcomes

Not Guilty

Great news! Your bail (the fine amount you paid) will be refunded. The violation won't appear on your driving record.

Guilty

If found guilty, you have 20 days to request a Trial de Novo (a new in-person trial). This is like a "do-over" where you can present your case again in person.

No Response from Officer

If the officer fails to submit their statement, this often (but not always) results in a dismissal in your favor.
